Miles and MacCraig Warren were a bit baffled when a U.S. Airways employee told MacCraig to remove his baseball cap and telling Miles to change into a button-up shirt, nicer shoes and slacks. They were told that this was the policy if they were to fly First Class on the plane, however when they boarded the plane they saw two other passengers, one caucasian, the other Filipino wearing the same hooded sweatshirt and jeans they were told they could not wear. The Warren brothers were traveling back home from Denver to Los Angeles after a relatives funeral, and they did not want any trouble so they adhered to the policy. Their lawyer Rodney Diggs told the New York Daily News, “They were very upset when they saw the other two gentlemen sitting right across from them… This is definitely racial discrimination and a violation of their civil rights.” The brothers filed a lawsuit against the airline seeking punitive damages for discrimination and emotional distress.
