Tech Talk Mobile: AT&T Won’t Appeal Decision in Throttling Suit

AT&T won’t appeal after all a data throttling case it lost in small claims court to a customer, one of a growing number of lawsuits against companies for reneging on marketing claims. The wireless carrier agreed Friday to pay $850 in damages and $85 in court costs awarded to wireless customer Matthew Spaccarelli by a small claims court in California in February, according to The Associated Press. @Yungjohnnybravo @TatWZA

Tech Talk News: Man Wins Lawsuit Against AT&T For Unlimited Data Speeds!!

Tiered data plans has become the norm for many major cell phone carriers due to the growing rate of smartphone owners. If you are grandfathered like me though you do not have to be a pauper with web browsing on your smart phone. Some companies though started slowing down speeds for heavy data users but Matthew Spaccarelli wasn’t having it. Check out his story after the jump. AT&T is offering a settlement to an iPhone user who won a small-claims case that alleged the company was slowing down his “unlimited” data service. AT&T isn’t saying if it’s offering Matthew Spaccarelli more money, but it says it will look at shutting off his service if he doesn’t sit down to talk. AT&T had no immediate comment. Spaccarelli, of Simi Valley, Calif., admits that he has used his iPhone to provide Internet access for other devices, which is against AT&T’s contract terms. AT&T has about 17 million smartphone customers on “unlimited” plans, and has started slowing down service for users who hit certain traffic thresholds. Spaccarelli maintained at his Feb. 24 small-claims hearing that AT&T is breaking its promise to provide “unlimited” service. A judge awarded him $850. HP
