An Irish bartender has been charged with raping a tourist in New York after he and a friend took her back to another woman’s flat from an East Side bar. Continue reading after the jump.
Damien McGuinness, 22, is accused of sexually assaulting the woman inside an apartment near Columbia University after his friend, who is also Irish, had sex with her.
‘What started out as a consensual encounter between the defendant’s friend and the complaining witness ended with the defendant raping [her],’ Assistant District Attorney John Temple told a Manhattan court yesterday.
Police sources said the woman said that McGuiness’ friend Brian Duddy, 24, had sex with her and then held her down while McGuiness violated her, reported the Daily News.
The 22-year-old woman reported the alleged attack at 4:45am after the pair left the apartment.
They were arrested at a nearby subway station at 5:20am after officers heard them speaking with thick Irish accents.
Charges against Duddy were later dropped and he was released.
‘[Duddy] told detectives that anything that transpired was consensual and that he was the only other witness to the incident,’ McGuinness’ public defender, Brad Sage, told the judge.
A judge ordered that McGuinness, who has lived in Queens for around a year, be held on a $5,000 bond.
When the judge asked him to surrender his passport, McGuinness said he’d lost the document along with his license.
