In 2014, Kevin Roper was driving a Walmart truck on the New Jersey Turnpike when he plowed into a limo; killing one man and severely injuring comedian Tracy Morgan. Although a National Transportation Safety Board concluded, after an investigation, that Morgan and the other occupant of the limo were not wearing seatbelts, it also concluded Roper was sleep deprived.
Today [Dec. 23] a grand jury decided to charge Roper with first-degree aggravated manslaughter, second-degree vehicular homicide and third-degree aggravated assault-charges that he prayed would be dropped.

David Glassman, Roper’s attorney, made an attempt to make sure that vehicular homicide and assault charges were, but to no avail. He also argued in court that Walmart’s settlement with Morgan made it difficult for his client to gain a fair trial.
Arraignment has yet to be scheduled.
