The Court of Appeals, in a 4-3 decision Tuesday, said exotic stage and couch dances do not qualify as “dramatic or musical arts performances” and as such should not be exempt from sales taxes.
The justices, who were shown videos of dancers performing their routines in bikinis, ruled that if ice dancing and other forms of entertainment — including sporting events — are taxable, so too are lap dances.
