It seems Apple actually Filed before Android(Google) dropped the News, June 29th, 2010 to be exact, now we will have to see what the patent office says!
it works by comparing a current image of your face to a reference model user profile(if there are multiple user’s) made using “high information” portions of the human face, like eyes and mouths. Pretty much like how Ice Cream does it. Here’s the patent Apple Filed:
