Kimberly Cantos, from Brooklyn in New York, pleaded guilty to second-degree manslaughter for the death of her little girl Ginelis, who was also malnourished when she died three years ago.
Cantos turned a blind eye to the abuse suffered by her children at the hands of their father, Michael Jimenez, it has been reported.
While she was not accused of directly abusing them, she was punished for allowing her daughter and younger son to stay with their father alone – despite knowing he beat them.
She will now serve between one and three years behind bars while Jimenez, who repeatedly battered the youngster, serves a life sentence after he admitted her murder.
According to sources quoted in the New York Daily News, Cantos had considered using a defence of battered woman syndrome.
However, this was retracted after a prosecution expert was prepared to tell the court that she took the children out of the home on several occasions – only to return and live with Jimenez.
The source said: ‘She preferred to be with him than to protect the kids.’
If Cantos had pleaded not guilty, her case would have gone to trial and she faced the possibility of being jailed for up to 15 years had she been convicted.

Her lawyer Douglas Appel said: ‘She’s very remorseful of what happened.
‘Not a day goes by that she’s not upset, that she’s not crying, that she doesn’t think of the mistakes that she made.’
Proceedings are now in motion to revoke Cantos’s parental rights over her son, who is now four years old and is in the care of a foster family.
Cantos will be sentenced on September 12.
