U.S. District Judge J. Thomas Marten issued his ruling Monday.

Planned Parenthood of Kansas and Mid-Missouri had argued that it would have suffered irreparable harm if a temporary injunction were not issued. It contended it would be forced to close one or more clinics and raise fees.

The state claimed public agencies could handle those patients.

Planned Parenthood argued that the provision unconstitutionally imposes additional conditions of eligibility for a federal program that are not required by federal law.

The state argued that an injunction would unconstitutionally replace the state’s discretion with the court’s judgment.
