The two cops acquitted of raping a drunken Manhattan woman had previously been accused of berating an intoxicated woman, calling her names when she tried to report a theft, sources said Wednesday.
The woman, now 24, filed a complaint with the Civilian Complaint Review Board, accusing officers Kenneth Moreno and Franklin Mata of abusive language in the Aug. 21, 2008 incident.
The board substantiated the complaint only against Mata.
The Manhattan District Attorney’s office decided against using the woman’s account in the rape trial, sources said.
The DA’s office had no comment, and the CCRB confirmed only that it investigated a complaint on that date.
It was not immediately clear what action, if any, the NYPD took against Mata.
Moreno and Mata were fired May 26, just hours after after they were acquitted of rape.
They were convicted of official misconduct for going back to the woman’s apartment three times without telling their superiors.
Lawyers for the Mata and Moreno could not immediately be reached for comment.
